This Privacy Policy outlines a number of matters relating to the types of information we collect and how we collect, use, disclose and protect your information. It also sets out how you can access and change your information, and matters relating to complaints.

Whether you are new to Property Dollar or a long-time user, please take the time to get to know our privacy policies.

By using our services and apps, and accessing our websites, you are taken to have read, understood and agreed to the matters outlined in this Privacy Policy.

Property Dollar operates the following website across desktop, mobile, tablet and apps (including any subdomains): www.propertydollar.com.au (the Website).

Property Dollar also operates an application across desktop, mobile, tablet or any other devices capable of accessing applications, also called Property Dollar (the App).

When we refer to our “Property Dollar Services”, we are referring to the Website, App, emails and any new technology we implement on any of these platforms or a combination thereof.

3. Privacy Laws

Property Dollar and all of its products and services operate in Australia. As such, in addition to our Privacy Policy, we are bound by the Australian legal framework for privacy and data collection in Australia.

The primary legal framework is comprised of:

1.    The Privacy Act 1988 (Cth) (the Privacy Act);

2.    The Australian Privacy Principles found at Schedule 1 of the Privacy Act (the APP); and

3.    The Telecommunications Act 1997 (Cth).

Property Dollar is proud to uphold the practices, procedures and systems imposed by the Australian Privacy Principles and takes its compliance obligations seriously.

5. Collecting Information

Property Dollar only collects and holds information that is reasonably necessary for our business functions and activities.

5.1         What we mean by “personal information”:

  • Personal information is information which identifies you as an individual or from which your identity can be reasonably ascertained.

  • The information that Property Dollar collects from and about you depends on how you use our Property Dollar Services and interact with us.

5.2         The kinds of information we may collect includes, but is not limited to:

1.    Contact details

(i)           Name;

(ii)          Address;

(iii)         Email address;

(iv)         Telephone/mobile number; and

(v)          Image/profile picture.

2.    Property details

(i)           Address;

(ii)          Property attributes (e.g., number of bedrooms, bathrooms and car spaces);

(iii)         Property type (e.g., house or unit);

(iv)         The estimated property value;

(v)          Sale and rent history;

(vi)         Owner details;

(vii)       Rates and levy details/notices; and

(viii)      Property images and videos.

3.    Financial information

(i)           Information about your existing mortgage(s);

(ii)          The interest rates on your mortgage(s);

(iii)         The tenure of your mortgage(s);

(iv)         The lender under your mortgage(s); and

(v)          Repayment history of your mortgage(s).

4.    Activity and cookies

(i)           Data collection devices called “cookies”.

5.    Location information

(i)           GPS; and/or

(ii)          IP address. An IP address is a number that is assigned to your device automatically and is required for using the internet.

6.    Records

(i)           Records of communications (including emails and telephone calls).

6. How we collect information

We set out below the ways in which we may collect your information:

6.1         Directly from you

1.    If it is reasonable and practicable to do so, we will collect your information directly from you. We may do this when you register, use or access Property Dollar’s products and services. We may also collect your information directly from you in other ways, including when:

(i)           We have a conversation with you over the telephone or in person;

(ii)          You send an email or letter to us;

(iii)         You disclose your information during other communications with us, whether electronically in an app, in person, over the phone/mobile, or in an email or letter;

(iv)         You complete an online enquiry or application form;

(v)          You enter a competition with us;

(vi)         You update your profile, such as updating your name, email address, telephone/mobile number(s) and social media profiles.

6.2         Indirectly

If it is unreasonable or impracticable to collect your information directly from you, we may collect it from third parties. This may include collecting your information from public databases, introducers, information service providers, government entities, financial institutions, finance or mortgage brokers, credit reporting bodies, verification bodies, accountants, lawyers and referees.

We may also collect and store your information if we have received it from third parties, without having asked for it. In this instance, we will only store it if we could have otherwise collected it from you in accordance with this Privacy Policy.

If we determine that the information does not accord with this Privacy Policy we will attend to destroying or de-identifying the information, but only if it is lawful and reasonable to do so.

6.3         From our website and app

We will not collect your information when you use our Website or App, except in accordance with this section and unless you have completed an online application form. To avoid doubt, no personal information is collected if you are simply browsing the Website.

For all visitors browsing our Website or using our App, we use “cookies” and our systems to collect information such as the server your device is logged on to, your browser type (e.g., Internet Explorer, Chrome or Firefox and etc.), the date and time of visit, pages visited, your IP address and any information downloaded.

“Cookies” are files placed on your hard drive to collect information. Your browser will generally be set to automatically accept cookies. If you do not want any cookies to be placed on your hard drive, you can change your browser settings to refuse them. However, this may also limit the way you view the Property Dollar Website or App.

Once you have registered for the App or Website, we also collect information about your use of Property Dollar’s products and/or services and information that you provide while using those products and/or services. This information may include your location and your device’s IP address. Your location is only recorded by Property Dollar while the App is running, however, your device may have the ability to run apps in the background. As such, you may need to specifically shut down the App to stop location recording.

7. Purpose of Collecting Information

We only hold, use and disclose your information for the purposes outlined in this section, or for related purposes which might be reasonably expected. We will never use your personal information outside of the reasons outlined in this section without first obtaining your consent.

7.1         To provide our products and services

Property Dollar offers a wide range of services which relate to the property market in Australia. We collect, share and use your information:

1.    To facilitate your use of Property Dollar’s products and services;

2.    Enhance your use of the Property Dollar products and services;

3.    To personalise Property Dollar’s products and services;

4.    To improve the content offered;

5.    To analyse usage of Property Dollar’s products and services;

6.    To develop new products and services;

7.    To provide insights on the Australian property market to our participants;

8.    To streamline the process of purchasing a property in Australia;

9.    To assist in managing an Australian property;

10. To respond to requests by you and/or other participants;

11. To notify you of important changes to our products and services;

12. To verify your identity;

13. For statistics, reporting and website administration and maintenance;

14. To provide, maintain, protect and improve Property Dollar’s products and services;

15. For verification purposes;

16. For billing purposes; and/or

17. For marketing and promotion purposes (see “Direct Marketing” section below).

Our participants include consumers, app users, website users, financial institutions, mortgage brokers and government organisations.

7.2         Direct marketing

From time to time, we may use the information collected from you (including from cookies) for direct marketing purposes, promotions, special offers and like-matters which we think you may find interesting.

We may contact you by telephone, electronic messages (such as email), online (including websites, push notifications and/or mobile apps) and other means for these purposes.

If we do contact you in this way, it will only be in relation to matters that participants would reasonably expect us to contact them about.

If you no longer wish to receive any direct marketing communication from us, please follow the instructions for unsubscribing in our marketing communications, or otherwise,  please contact us.

To avoid doubt, we do not sell personal information to other third-party organisations to allow them to contact you for direct marketing purposes.

7.3         Miscellaneous

1.    From time to time, we may use records of communication containing personal information (including emails and telephone calls) for staff training and development.

2.    We may also use your IP address to derive the general geographic area associated with that IP address.

8. Where and How Your Information is Stored

We may store your information in hardcopy and/or in electronic form on servers that are located within Australia. We take reasonable steps to protect the information we hold from misuse, interference and loss, and from any unauthorised access, modification or disclosure.

When your information is no longer needed for the purpose for which it was obtained, we will take reasonable steps to destroy or permanently de-identify it.

If we are in possession of personal information which is not reasonably necessary for our business functions and activities, we will destroy or de-identify it.

When you delete your Property Dollar user account in the manner contemplated by Clause 11.3 of this Privacy Policy, we will delete your personal information within a reasonable period of time. However, we will keep any property details provided by you for a period of one (1) year for analytical/data purposes and in order to allow us to render Property Dollar services and products generally.

Our application includes a features to detect jailbroken or rooted devices. This functionality is implemented to ensure the security and integrity of our application and its data. Jailbreaking or rooting a device can compromise its security mechanisms, potentially exposing the application and user data to unauthorized access and malicious activities.

9. Disclosure of Your Information

Property Dollar will only disclose your information in the following circumstances:

1.    If required by law;

2.    If Property Dollar believes, in its sole discretion, it is in the public interest;

3.    To seek feedback, or monitor or improve quality of service;

4.    To entities who assist Property Dollar in providing, administering, supporting, improving, promoting, analysing and marketing Property Dollar’s products and services;

5.    To suppliers, contractors, debt collectors, data storage and management companies (including providers of cloud services), website hosting service providers and interactive advertisers;

6.    To companies that promote and market, or conduct research to help Property Dollar improve and target its products and services;

7.    To related corporate bodies;

8.    Where Property Dollar otherwise obtains your permission to disclose the information, for example, where you opt to allow unrelated third parties access to certain documents; and/or

9.    To third-parties directly engaged and endorsed by Property Dollar for direct marketing, promotions, special offers and like-matters.

Any time that Property Dollar shares your information with a third-party in accordance with this section, Property Dollar will ensure that that party deals with your information with at least the equivalent protection as provided by this Privacy Policy.

We may also publicly share information that will not personally identify you. For example, to show trends about the general use of Property Dollar’s products and services.

When you have provided personal information for a particular purpose, we may disclose your information to certain third parties that we have engaged to assist us in fulfilling your request. We will use reasonable endeavours to ensure that these third parties are only permitted to use the personal information for the particular purpose for which they were asked to assist.

Property Dollar will not disclose your personal information to overseas recipients without your express permission.

11. Accessing and Correcting Your Information

We seek to maintain reasonable and adequate security measures in order to attempt to protect against:

1.    Unauthorised use, disclosure or access; and

2.    The loss, misuse or alteration,

of your information under our control.

Although we strive to protect information capable of personally identifying you, we cannot ensure or warrant the security of any information:

  1. You transmit to us through or in connection with our Website or App;

  2. That we store on our systems; and/or

  3. That is stored on our service providers’ systems.

To the extent permitted by law, Property Dollar accepts no responsibility and/or liability for any such disclosures of your information.

You acknowledge and agree that no transmission of data over the internet or phone is guaranteed as wholly secure and that any information you provide to Property Dollar through the internet or phone, including email, is at your own risk.

You may also assist Property Dollar in keeping your information secure by maintaining the confidentiality of your account information and notifying Property Dollar immediately if there is any unauthorised use of your account or any other breach of security relating to your account.

10. Security

11.1         Access

Under the Privacy Act, you are entitled to access your information and to do so in a manner that you request, provided that it is reasonable and practicable. You can make an access request by letter, email or telephone.

We will not charge any fee for your access request but may charge an administrative fee for providing a copy of your information.

We will need to validate the identity of anyone making an access request, to ensure that we do not provide unauthorised access.

We will acknowledge your access request within five (5) business days, and endeavour to provide you with access within thirty (30) days if it is reasonable and practicable to do so, but in some circumstances it may take longer.

Your rights to access information are subject to some limitations. For example, we do not have to provide you with access if:

1.    Doing so would pose a serious threat to the life, health or safety of any individual, or to public health or public safety;

2.    It would have an unreasonable effect on the privacy of others;

3.    Giving access would be unlawful;

4.    The request is frivolous or vexatious;

5.    The information relates to existing or anticipated legal proceedings between Property Dollar and you, and would not be accessible by the process of discovery in those proceedings;

6.    Giving access would reveal the intentions of Property Dollar in relation to negotiations with you in such a way as to prejudice those negotiations;

7.    Denying access is required or authorised by or under an Australian law or a court/tribunal order;

8.    Property Dollar has reason to suspect that unlawful activity, or misconduct of a serious nature, that relates to our functions or activities has been, is being or may be engaged in; and giving access would be likely to prejudice the taking of appropriate action in relation to the matter;

9.    Giving access would be likely to prejudice one or more enforcement related activities conducted by, or on behalf of, an enforcement body; or

10. Giving access would reveal evaluative information generated within Property Dollar in connection with a commercially sensitive decision‑making process.

If access is refused, we will give you a notice explaining our decision, including if any of the above exceptions applied to your request, as well as your options to make a complaint.

11.2         Correction

We take reasonable steps to ensure that all information we hold is as accurate as possible. From time to time your information may change. It is important that you inform Property Dollar of changes to your details as and when they occur.

If the personal details we hold for you are incorrect, you are able to contact us at any time to request that we correct that information. We will endeavour to resolve your correction request within thirty (30) days of you making a request. There will be no cost to you if we correct your information held by us.

11.3         Account Deletion

You may remove your Property Dollar personal account via the “Account details” page on the Website or App, as follows:

1.    Click on “More”,

2.    Click the “Account deletion” button.

Once you confirm the deletion, your personal information will be removed from our database, subject to retention clauses in this Privacy Policy.

12. Complaints

If you have any questions or concerns about our Privacy Policy, the privacy of your information, or if you are concerned that your privacy has been compromised, please contact Property Dollar immediately. We will ensure that you speak to a member of our team who will listen to your complaint and will explain to you the way the complaint is being dealt with. We are committed to resolving your complaint in a timely manner.

You will always have the option to provide anonymised feedback or complaint to Property Dollar. We will never compel you to disclose your identity if you have elected to remain anonymous and will deal with your feedback or complaint in the same manner irrespective of whether you have chosen to disclose your identity or not.

13. Links

The Website and App contain links to third party websites. Property Dollar is not responsible for the information on these sites or their privacy policies. Property Dollar may keep track of your interaction with these third-party websites in order to improve Property Dollar’s product and services, and to aggregate statistics for the benefit of Property Dollar and other third-party service providers.

14. Changes in our Privacy Policy

Property Dollar may amend this Privacy Policy from time to time. If amendments are made, the amended Privacy Policy will be published on the Website and made available through the App.

You acknowledge and agree that it is your responsibility to check for updates on this Privacy Policy. You further acknowledge and agree that your continued use of the Website and/or App will be considered as acceptance of Property Dollar’s amendments to the Privacy Policy. This Privacy Policy was last updated in August 2023.

15. Application Restrictions

Our application is designed to work only on non-jailbroken or non-rooted devices. If a device is detected to be jailbroken or rooted, the application will not function. Users must install and use the application on a real device that has not been tampered with to ensure its proper operation and security.
